Terms of Service

📋 By using Takus, you agree to these terms. Takus is provided free of charge as an open-source tool.

1. Acceptance of Terms

By accessing or using Takus (the "Service"), available at https://takus.netlify.app, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Takus is a free, client-side web application that allows you to:

Capture your screen and/or webcam directly in your browser, or import documents and meeting notes
Trim, watermark, and convert recordings to MP4 or GIF
Upload recordings to your own cloud storage account (Google Drive or Microsoft OneDrive)
Generate AI-powered transcriptions, summaries, and task extraction (requires your own OpenAI or Gemini API key)
Track goals, tasks, and people across your captured knowledge
Link recordings to matching Google Calendar or Outlook calendar events
Create meeting notes documents in Google Docs or Microsoft OneNote

The Service operates entirely within your web browser. We do not operate backend servers that process or store your recordings.

3. User Responsibilities

You are solely responsible for:

Recording consent — Obtaining proper consent from all participants before recording any calls, meetings, or conversations. Recording laws vary by jurisdiction.
Content legality — Ensuring that recorded content does not violate any laws or the rights of third parties.
Credential security — Keeping your OpenAI API key, Google account, and Microsoft account credentials secure.
Cloud storage — Managing your own Google Drive or OneDrive storage limits and file organization.

4. Prohibited Uses

You agree not to use Takus to:

Record conversations without the knowledge and consent of all parties where required by law
Create, distribute, or store illegal content
Violate the privacy or intellectual property rights of others
Reverse engineer, modify, or create derivative works of the Service in violation of its license
Attempt to bypass browser security restrictions or access other users' data

5. Google API Services

Takus integrates with Google APIs (Drive, Calendar, Docs) to provide cloud features. By connecting your Google account, you also agree to Google's Terms of Service.

Takus's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

You can revoke Takus's access to your Google account at any time through your Google Account settings.

6. Microsoft Graph Services

Takus integrates with Microsoft Graph (OneDrive, Outlook Calendar, OneNote) to provide cloud features for Microsoft accounts. By connecting your Microsoft account, you also agree to the Microsoft Services Agreement and the Microsoft Privacy Statement.

You can revoke Takus's access to your Microsoft account at any time through My Account → Privacy → Apps and services.

7. OpenAI API

If you supply an OpenAI API key in Settings, Takus sends extracted audio and the resulting transcript directly from your browser to OpenAI's APIs. You are bound by OpenAI's Terms of Use and API data usage policies. You are responsible for any charges incurred against your OpenAI account.

7a. Google Gemini API

If you supply a Google Gemini API key in Settings, Takus sends extracted audio and transcript data directly from your browser to the Gemini API (generativelanguage.googleapis.com) for transcription, summarization, and embedding generation. You are bound by the Google AI Terms of Service and Gemini API Additional Terms. You are responsible for any charges incurred against your Google Cloud account.

8. Intellectual Property

Takus is open-source software. The source code is available on GitHub. Your recordings and any content you create using the Service remain your property.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, error-free, or secure
Recordings will be saved successfully in all cases
Cloud uploads will always complete successfully
AI transcriptions will be accurate

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TAKUS, ITS DEVELOPERS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF RECORDINGS, OR BUSINESS INTERRUPTION.

11. Data Loss

Because Takus operates entirely in your browser, recordings may be lost due to:

Browser crashes or tab closures during recording
Insufficient browser memory for long recordings
Network interruptions during cloud uploads
Clearing browser data or site storage

We recommend downloading important recordings locally as a backup.

12. Changes to Terms

We may update these Terms from time to time. Changes will be reflected on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
